These Terms of Service ("Terms") govern your use of thefrolic.app ("Frolic", "the platform"), operated by The Frolic App Pty Ltd(ACN 697 066 265, ABN 61 697 066 265), registered in Victoria, Australia ("we", "us", "our"). By using Frolic, you agree to these Terms. If you do not agree, do not use the platform.
Frolic is a party coordination and payment platform that helps organisers plan group events (hens parties, bucks parties, birthdays, farewells, and other celebrations), collect activity preferences from attendees, split costs, and process payments. Frolic is not a venue operator, event planner, or travel agent and does not guarantee the availability, quality, or suitability of any activity or venue suggested on the platform.
You must be at least 18 years old to use Frolic. By using the platform, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
When you create an event, you are the "organiser" and are responsible for the accuracy of event details and for fulfilling the activities and experiences you communicate to attendees. Frolic provides the coordination and payment tools — the organiser is responsible for booking venues and managing the event itself.
Frolic charges a platform fee of 2.5% on all payments processed through the platform. This fee is deducted automatically before funds are transferred to the organiser.
When creating an event, the organiser can choose how Stripe's payment processing fees are handled:
Stripe's standard payment processing fees (currently 1.7% + 30c per transaction for Australian cards) apply in both cases and are separate from Frolic's 2.5% fee. Stripe fees are subject to change by Stripe — see Stripe's pricing page.
All payments are processed by Stripe. Frolic does not store credit card or bank account details. By making a payment through Frolic, you also agree to Stripe's terms of service.
By adding your bank details as an organiser, you agree to Stripe's Connected Account Agreement, which governs how Stripe processes payments and payouts on your behalf. Frolic facilitates the connection but is not a party to the agreement between you and Stripe.
Refund requests for event payments must be directed to the event organiser. The organiser is responsible for managing refunds for their event. If an organiser issues a refund via Stripe, Frolic's 2.5% platform fee on the original payment is non-refundable once processed.
Frolic allows users to upload receipts and split expenses among event attendees. Frolic facilitates these calculations but is not a party to any debt or obligation between attendees. Any disputes about expense amounts or splits are between the attendees involved.

All content, design, and code on thefrolic.app is owned by The Frolic App Pty Ltd. You retain ownership of any content you upload (e.g. receipt photos, event descriptions). By uploading content, you grant us a limited licence to display and process that content for the purpose of operating the platform.
To the maximum extent permitted by law (including the Australian Consumer Law), Frolic's total aggregate liability for any claims arising from your use of the platform is limited to the total platform fees paid by you to Frolic in the 12 months preceding the claim.
Frolic is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the platform.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any similar legislation that cannot be excluded, restricted, or modified by agreement.
Frolic is provided "as is" and "as available". We do not warrant that the platform will be uninterrupted, error-free, or that any defects will be corrected. Venue suggestions and activity information are provided for convenience only — we do not guarantee their accuracy, availability, or suitability for your event.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of Frolic after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of Frolic will be subject to the exclusive jurisdiction of the courts of Victoria.
